Having considered the kind of behavior that creates personal jurisdiction in Massachusetts, how does one go about serving such a person/entity with the complaint? What is the method of service outside of the Commonwealth? By far the easiest and probably most often used method is by relying upon (3) of Massachusetts General Laws 223A S.6: “by any form of mail addressed to the person to be served and requiring a signed receipt.” That is a straightforward and expeditious method of obtaining service on an outside entity. Even if they are not seen and not heard, jurisdiction will lie against them if, for example, they have caused tortious injury in the Commonwealth, and certified mail is the best method to gain service or process. Once the signed return receipt card is received, it should be filed with the court as is the case with any return of service. Of course, you can use other methods of service as well but 232A, S.6 should be considered first.
