According to the CDC, between 2001 and 2008, more than 34,000 motorcyclists were killed and an estimated 1,222,000 persons were treated in a U.S. Emergency Department (ED) for a non-fatal motorcycle related injury. Motorcycle accident death rates increased 55% from 2001 to 2008. According to statistics that are readily available, in 2005, there were 56 motorcycle accidents that resulted in fatalities in Massachusetts, which meant that motorcycles were vastly disproportionate in the overall fatality rate. Drivers must be wary of motorcycles and pay proper attention in order to avoid serious accidents. A biomechanical degree is not needed to realize that because the motorcycle-rider’s body is exposed when he or she is in motion, the greater the likelihood of a serious injury.
When I first started practicing personal injury law, seminar speakers always pointed out that there is a bias against motorcycle operators. Thankfully, based upon the results that I have seen, that is not the case. Furthermore, while generalizations are best avoided, I can say that the motorcycle clients I have had have been extremely responsible in all respects, including the way they drive.
